What is Real Estate?
Real estate is a legal term that is used to refer to land along with improvements to land, such as adding fences, digging wells, planting trees, building buildings, and other improvements that are not moveabe from the location. As an example, a pile of wood located on your property would not be considered to be a piece of real estate because it is moveable and not fixed to the land.
Real estate law has to do with the regulations and legal what-not and codes pertaining to real estate. For example, anyone can own real estate, but not everyone can sell real estate. Commonly real estate is referred to as used almost synonymously with the term real property which is sometimes referred to as realty. Realty is different from personal property. Personal property is sometimes referred to as chattel, which I personally find to be odd.
However, in Tulsa and various other places on the planet Earth, the term "real estate" refers to the land and fixtures together. This very different from "real property" which refers to the ownership of the land and appurtenances including the permanent nature of such structures as the trees, minerals, and the interest, benefits and the inherent rights there of. The terminology of real estate and real property is used primarily in common law or by people who own and or intend to own physical real estate in the future. I personally think it would all be much better if we had a simpler system to name these things.
