Patent is rights providing the inventor and/or the applicant with the right to prevent others from exploiting the invention mentioned in the patent. The monopoly is granted for maximum 20 years by the state in return for a full disclosure of the invention. An application for a patent can be filed by the true and first inventor. The assignee or legal representative of the inventor can also file it. It can be filed individually or jointly. The applicant can be national of any country. a person registered to practice before Indian Patent Office is called a Registered Patent Agent or simply Patent agent. The Patent Cooperation Treaty (PCT) is a worldwide agreement to simplify the filing and processing of patent applications.

The following documents have to be submitted at the time of filing a patent application:
a. Form 1 - Application for the grant of patent.
b. Form 2 - Provisional or Complete Specification.
c. Form 3 - Statement and undertaking by the applicant.
d. Form 5 - Declaration as to inventorship.

DQS LPO Patent Services gives an exclusive right to the person who has invented a new item (or improved an existing item or a new process of making the item), the exclusive right to manufacture item according to invented process for a limited period (maximum 20 years). Law prevents other person from using the patented invention during the term of the patent. After the expiry of the term of the patent the invention become public and anybody can use it.

Normally, non-patentable matter can be verified by you; however it is advisable to cross-check from your patent agent or patent attorney. In case, your invention falls under above list, you will not be required to pursue patentable analysis and/or patenting your inventio. Thirdly, of course the claim must arise out of a failure in the professional services provided. There is some limited coverage afforded under the Professional Liability for faulty workmanship, materials and/or components.
