Termination letters are written after deciding to terminate someone from a position . The person is terminated due to major issues . The letter consists of the reason of terminating.
Termination letters
are given for an employee dismissal, due to poor work performance, negligence
and late arrival at office and so on.
If you find any
employee’s performance not up to the mark, the immediate step to terminate his/
her service is issuing termination letters to the employee. There are several
reasons for which the employer has to issue termination letters for employment
dismissal. These reasons mostly include poor work performance, misconduct,
negligence, late arrival at the work place every day, continuous absence from
the job, redundancy and so on.
There may be
many reasons to terminate an employee but it is not that easy to remove any
worker from the active service. It is so because there are certain provisions mentioned
in the Employment Act which protects the right of the employees and few clauses
to be followed, for maintaining employee’s relation.
There are also
chances of the worker creating problems to the employer if he/ she is
dissatisfied and might draw penalty for employer from the employment law. The association
of the employee with the worker union is also an imperative aspect. An employer
should give appropriate concern because; the union may create pointless tensions
and troubles for the elimination of the employee.
Hence, it is
advisable that, before firing the service of the worker, the employer must discuss
with labor experts, trade union and completely obey the provisions of the
Employment Law. The employer is also allowed to tender advance termination
notice and compensation to the employee according to the Employee Hiring
Agreement.
There are two
types of Termination documents that are issued against the employee:
1.
Termination certificate
- for cause:
This note is issued to the employee for his ‘poor quality of work’. The
employer may find the work of the employee not up to mark.
2.
Termination document - unsatisfactory
probationary period: When
a worker is provided sufficient probation period, to show his ability and, if
he fails to prove his/ her skill, a termination letter will be issued
immediately under unsatisfactory probationary period.
The Employment termination
letters should consider the following points while dismissing the worker:
• Name of the worker.
• Reason to dismiss the employee.
• Loyalty to the Employment Law
• Removal of benefits, presented to the employee, during hiring.
• Employment verification (time of hire, day of termination, and job title).
• Commands to return, company credentials, belongings and articles, in the tenure
of the employee.
