The police have a vast array of speed detection equipment at their disposal but this fact alone is enough to cast doubt over the accuracy of many of the readings that are given and that are submitted as evidence against drivers for speeding. Being prosecuted for speeding can lead to penalties that include both points and cash fines, and if you already have points on your licence then you run the risk of having your licence suspended through the totting up scheme.

In order for the police to prosecute in a speeding case, they must prove guilt beyond reasonable doubt and the production of a photo taken by a speed camera is not enough, on its own, to prove this. Despite the best efforts of the prosecution, if the court decides that there is any doubt whatsoever then they must acquit you.

Photographic, or even video, evidence may be provided by the prosecution but they must then prove beyond doubt that the evidence is accurate. Typically, speeding tickets will first be contested by your barrister cross-examining the police officer in order to ensure that all protocol and procedures were followed before the camera was used to gain photographic evidence. With more than 50 different types of speed camera being used, it is quite possible that inaccurate procedures were followed.

Speeding tickets can be contested. The case will go to court although it may not be necessary for you to attend. Employing a barrister or solicitor who specialises in fighting these cases could save you more than a £60 fine and 3 points on your licence. Excessive speeding can lead to the loss of your licence, and so too can reaching 6 or 12 points as part of the totting up scheme.

The court does not treat photos taken by speed cameras as being absolute proof of guilt. The police and prosecution must then prove beyond reasonable doubt that you were guilty of the offence that you have been accused of. Simply paying a fine or attending court yourself without legal assistance could lead to points on your licence and a monetary fine.
