If you are sued, your insurance policy may not provide full coverage for every claim asserted. In such an instance, your insurance company will partially represent you and will state that they are representing you under a “reservation of rights.” In such an instance, it is wise to hire your own attorney to assist you and protect your rights against your own insurance company.

It can be a challenge for an individual to be fairly compensated for a personal injury claim. Changing the system to make it more difficult for the injured party (the little guy) to receive fair compensation from an insurance company (the big guy) would be comparable to making it more difficult for David in his next battle with Goliath.

If you have a personal injury claim, there is an alternative to waiting two years to get to trial, having a long drawn out trial, and waiting even longer while the case is appealed. The alternative is called Alternative Dispute Resolution (ADR) and consists of either mediation (settlement conferences with a third party facilitating the process) or binding arbitration (a mini quick trial) before an arbitrator who resolves the matter.
